1 Year Thai Visas

Thailand’s Immigration system has grown increasingly confusing as rules change, visa fees are waived, and some visa categories are placed under more intense scrutiny by Consular officials.

Recently, Consulates that were known as “visa run” destinations began restricting the issuance of multiple tourist visas. Places such as Penang, Malaysia and Vientiane, Laos are seeing a decline in “visa runners” as these new Consular policies drive them elsewhere. Many long term tourists as well as expatriates began toying with the notion of remaining in Thailand on non-immigrant or immigrant visas.

This brings up the issue of long term non-immigrant Thai visas. Non-Immigrant Thai visas can be issued for different durations. For this reason, a properly prepared Thai visa application is essential to acquiring the type of visa one desires. A collateral issue is that of work authorization. In Thailand, much like the United States of America, the right to work and the right to remain in the country are two different types of entitlements. Therefore, one must submit separate applications to separate government agencies in order to obtain a Thai work permit and a Thai visa extension.

Thai Immigrant visas, also known as Thai permanent resident visas, allow the bearer to remain in the Kingdom in perpetuity. However, these types of visas are very difficult to obtain and require one to spend a great deal of time as a non-immigrant resident in the Kingdom of Thailand. For some wishing to remain in the Kingdom for a long period of time, the retirement visa can be an effective method of immigrating. Applicants must be at least 5o years old to apply for this visa category. With that in mind, it is very beneficial for those with bona fide retirement intentions. Those in Thailand on this type of visa are not entitled to apply for a work permit.

Those thinking of staying in Thailand for a long period should seriously weigh all options and do as much research as possible before making the decision to move. This is particularly the case for people who think that they will be allowed to stay in the Kingdom of Thailand for an indefinite period in tourist visa or visa exemption status. An even worse notion is the idea that one can simply remain in Thailand on overstay (in the Kingdom without proper Immigration documentation).

Some people in the past would remain in the Kingdom for years without making certain that their immigration status was kept up to date. People of the opinion that this is an acceptable way of remaining in the Kingdom of Thailand should note that Royal Thai Immigration takes a dim view of visa violators and will detain them if caught. Also, a person without legal status cannot obtain a work permit or other necessities of residence.

Business In Thailand And Preference Shares

Most business activities in Thailand are prohibited or restricted for foreigners. Foreigners are generally not allowed to operate businesses in Thailand. Some specific business categories are absolutely prohibited for foreigners while others may be operated if an exemption and permission has been granted under a specific Act or treaty.

Instead of applying for a special business license or exemption under Thai law the most popular form of business entity among foreign investors in Thailand is the private Thai limited company (majority Thai owned) structured with preference shares allowing the foreign investor to control the company.

          ]]>

Under the current structure of the Foreign Business Act foreigners can operate most restricted businesses for foreigners by using preference shares.

Preferred or preference shares in Thailand are usually higher ranking shares giving the holders priority in certain matters of the company limited. The structure of preference shares opposite ordinary shares in a Thai company is typically used to give control over certain matters or preference in certain situations to a group of shareholders above another group of shareholders in the company.

For now, Thailand has not changed the preference structure allowing foreigners as a minority shareholder to control a Thai limited company, however there is a discussion in the Thai government and Ministry of Commerce if preference shares and foreign voting rights and management in a Thai company should be used as a criterion in defining a company foreign or Thai. With new regulations the government is currently discouraging foreigners to invest in Thai businesses by restricting the use of Thai nominee shareholders in a partly foreign owned Thai company, however has not issued restrictions on the use of preference shares and majority voting rights by foreign shareholders in a Thai company.

It is not yet known if foreign voting rights and management in a Thai company will be used as a future criterion under the Foreign Business Act in defining a Thai company a foreign company.

Five major department stores, 14 hotels and 30 bank branches in the heart of Bangkok have been forced to close for almost a month. And some foreign investors are thinking it may be time to pull out.
Some Thai Girls Aren’t Girls

Anyone who has ever visited Thailand will know about the beauty of Thai women. In their twenties, they are striking. In their thirties, they are looking more mature, but still most are very attractive.

The women working in the ubiquitous bars and massage parlors of Bangkok, Pattaya, and Phuket are mostly former housewives, believe it or not, married but separated, with two kids they left back in their village with their mothers. Most are from Isaan, the North-East corner of Thailand, which has a large amount of poverty. Some are from other parts of the country, especially Chiang Mai and Chiang Rai, and a very few are from Bangkok or central Thailand.

But about 1 in 100 is not a female at all, but a “ladyboy”, or katoey in Thai. Quite often, they appear more feminine than the real women. I have seen many a farang ogle and lust after a very sexy woman, not realizing that “she” is a “he”.

Like the women, most ladyboys are from Isaan. I have talked to a few on a one to one basis, and asked them when they first knew they wanted to be a female. All said they knew at an early age, around 5 or 6 years old. They said they liked the female manner, didn’t like rough sports, were partial to art and music.

Katoeys are an accepted part of Thai culture, considered to be a third sex in Thailand. Several are movie stars and TV announcers. One is a national kick-boxing champion. You will find ladyboys everywhere, working as waiters, store clerks, hairdressers, couriers, etc.

In North America and Europe, a sex-change (also called a gender re-assignment) operation is considered to be a big deal, requiring many months of psychological counseling before the operation to make sure the person is committed to the change.

In Thailand, a sex change operation is quite common. There are several clinics and hospitals which perform it, and the cost is a fraction of what the western charge would be, typically US00-7000. Nevertheless, for a poor person from Isaan, 00 is a huge amount of money.

          ]]>

There are three main areas in Bangkok where ladyboys are present in large numbers: Nana Entertainment Plaza (on Sukhumvit Soi 4), Patpong Road (off Silom), and Soi Cowboy (close to the intersection of Sukhumvit Road and Asoke Road, which has both BTS SkyTrain and MRT Subway stations).

At Nana, the majority of ladyboys are “pre-op”, meaning they still have a penis. At Patpong and Soi Cowboy, most are “post-op”, meaning they have had the operation to create a vagina. The operation involves cutting out a section of intestine, which will become the vagina. The penis is cut open and inserted into the intestinal tube; typically some of the scrotal sac is used to increase the length of the new vagina. The tip of the penis becomes the new clitoris, and is normally still sensitive after the procedure is finished and everything has healed. The ladyboys I talked to said they could still have an orgasm, but did not ejaculate.

Scar tissue is visible if the post-op ladyboy retains his/her public hair, but if it is shaved off, it is difficult to tell an artificially created vagina from the real thing.

However, this is typically not the end of the story in sex reassignment. The male body is typically larger than the female, even in Thailand, where many people seem to be 80% the size of western people. The ladyboy has to take hormones for a couple of years before the operation; these hormones help him grow breasts and reduce his facial and body hair growth. Thai men don’t usually have much body hair, compared to Western men, but they do have some; hormones or another treatment are needed to reduce or eliminate it. However, hormones have a side effect of reducing the ability to ejaculate.

Males typically have a protruding Adam’s apple, so that is yet another operation: it can be shaved by a surgeon to reduce or eliminate the protrusion. And many have electrolysis to eliminate body hair, especially in the armpits.

If you visit Nana Entertainment Plaza after 7PM (which is when it opens), you will find several hair-dressing establishments located on the decks that run around three sides of the structure. The ones at the front cater to the bar girls; the ones at the rear cater to ladyboys. You can watch some of the ladyboys preening and preparing their makeup.

Some of the bars are exclusively ladyboys. If you enter one such bar, you will find that most ladyboys are more than passable and some are strikingly beautiful. I don’t think I have ever seen an ugly ladyboy.

As far as relationships go, ladyboys are just like Thai women. They want a long-term relationship, and they will try hard to make the relationship work. Many speak some English, but you really need a product like Speak Easy Thai to help you learn some basic Thai vocabulary. If you can communicate better, you have a much better chance of a lasting relationship.

A part of Bangkok’s nightlife that should not be missed by any visitor, ladyboy cabaret shows are professionally done, with spectacular productions (lots of feathers and glitter, good music, and some comedy as well). You can see them at the Calypso Cabaret (Asia Hotel, Ratchathewi SkyTrain station), Golden Dome Cabaret (15 minute walk from Sutthisan subway station), and Mambo Cabaret in the former Washington Theater between Sukhumvit Soi 22 and 24.

Training Muay Thai and MMA in tropics of Thailand for weight-loss

I never thought that a vacation in the tropics of Thailand on the island of Phuket, Thailand could turn into a life changing experience, but it did. I spent nearly two months at the Tiger Muay Thai and MMA training camp on the island of Phuket, Thailand and had a wonderful time enjoying Thai culture, meeting the Muay Thai trainers and staff at Tiger Muay Thai, however, what happened was I ended up losing 21 pounds in almost two months and enjoying every minute of exercise and training Muay Thai.

I have never been too outgoing, but after seeing theri website, I was excited and decided that a vacation that could also be beneficial by losing weight, getting fit through exercise training Muay Thai two times each day, and also swimming and going to the beach. I was amazed.

          ]]>

I lost weight, gained muscle, learned a new Martial Art, Muay Thai, which is the National Sport of Thailand and a lot like kickboxing but with elbows and knees. I also got an incredible tan. At least 3 times a week myself and several friends I made while training at the camp would go down to Nai Harn, Kata, or even Karon beaches. Just beautiful stretches of white sand and ice blue water. We trained at the beach, had BBQ parties at the training camp with live music, and even real fights in one of the Muay Thai rings. There must have been 75+ people for the BBQ and full moon party.

If you have not considered a fitness vacation or weight-loss holiday, you should consider Tiger Muay Thai and MMA training camp, Phuket, Thailand. Wonderful people that changed my perspective on fitness holidays.

What I thought made the difference was the the way we trained Muay Thai and MMA in groups of beginners to intermediate to advanced. I started out as a beginner and by my 6th week at the camp my head Muay Thai instructor said I was able to move up into the next level of Muay Thai training.

The training camp offers “Boot Camp” fitness courses, Yoga, and running programs for fitness for those that like those types of exercise. There are on-site bungalows which are very affordable and a wide variety of resorts located within walking distance f Tiger Muay Thai and many of those have pools, restaurants, and air-conditioning.

I would rate my time at Tiger Muay Thai in Phuket, Thailand with 5 stars. I will certainly return as I made frinds that will join me again next year for weight-loss, training Muay Thai, and fun in the sun.

Take a chance and do something you thought you would never do. I did, and it was a wonderful experience that I will never forget. I never thought of a fitness holiday training Muay Thai and MMA. But I did it and feel great

Challenges of Doing Business in Thailand

Geographically, the country is at the centre of what was until the 1950s French Indo-China; however, the Thai people were never subjected to foreign colonial rule – a fact of which they are extremely proud.

Thai culture has been influenced and shaped by a number of diverse sources, such as Chinese culture and Buddhist and Hindu philosophies. This mix has led to a complex way of thinking which must be understood in order to interact successfully with the Thais. By completing a business management cross-cultural training programme such as Doing Business with Thailand, your organisation will be better equipped to form coherent strategies for profitable and enduring associations with counterparts in Thailand. Below are some of the major conceptual challenges to understanding Thai business culture and society.

The concept of saving face is important in Thai society. Thais will do anything to prevent loss of face, including avoiding confrontation or telling others what they want to hear rather than dealing with immediate issues. Criticising someone in public and not staying true to promises are various ways that people may be perceived to ‘lose face’ in Thailand.

          ]]>

Thailand is a collectivist society in which the needs of the group are often placed over those of the individual. Family and community concerns will almost always be put above business or individual needs. Family in particular plays an important role in Thai society. You will notice that close ties between extended families and communities can have a major influence on individual behaviour in Thailand and often there are multiple generations living under one roof.

Being subtle and indirect are valued characteristics in Thai communication. In conversation, a considerable part of the information lies in underlying messages or in non-verbal cues. Thai people avoid direct confrontation, and criticism, if given at all, is delivered indirectly.

As the cornerstone of Thai society, the family is attributed great value and importance. Thai families are close and several generations may live in the same house, with the oldest male being the head of the household. The power structure of the family is mirrored in the organisational environment. Advice from elders is expected to be followed without question, although this is becoming less true with time and modernisation.

Thailand is a fascinating and complex country, influenced by centuries of religious philosophy, immigrant know-how and wisdom coming from foreign trade and commerce. This complexity can be hard to understand for the outsider in Thailand, and an obstacle to doing business. By enrolling members of your organisation on a cross-cultural training programme such as Doing Business in Thailand or Living and Working in Thailand, your organisation will be able to form strategies to cope with and manage interactions when doing business in Thailand.

Thai Boxing – one of the most popular martial arts in the world

Thai Boxing or Muay Thai, derives from an ancient Thai fighting. This was real fighting art that was used on the battlefield, and also included the use of weapons of various kinds. Thai Warriors were much feared and respected for their fighting ability.
From this comes the deadly art Thai Boxing, a sport version and less bloody. It spreads quickly among the Thais at all levels.

Thai boxing currently considered one of the toughest arts and effective. Muay Thai has its origins in Mae Mai, the ancient Thai fighting technique. One of the most famous of Thai history, whose deeds are given on the school books and remember all the years at all stages of Thai, Nai Khanom Dhom that is captured by the Burmese army along with his soldiers during the sack of the ancient capital Ayudhaya, he won freedom by defeating unarmed 12 gladiators of the strongest enemies, all under the eyes of the Burmese King Mangra, who wanted to note closely the great power with which so famous was the Thai people, challenged the best of Thaiboxer prisoners and their reign of the King of Siam who was famous for being a formidable fighter, he faced 12 of the best local warriors who practiced a form of struggle, quite similar to that Parma or more commonly called the Thai-Burmese Boxing. The same Mangra King was so impressed by the effectiveness of his shots that he decided to grant him freedom. Since then, every March 17 is dedicated to his memory and in every stage of the kingdom is the day of all boxers.

Although it is now considered a sport for all purposes, Muay Thai is considered one of the hardest and most demanding specialties in the combat sports. Indeed it is possible to strike all parts of the body (except head) almost all of the opponent and you can make statements and projections fight. Even today, the Muay Thai-Thai is the national sport and is actively used by thousands of fans in big cities and small villages. In Bangkok, there are two main stages where you can see every day in numerous battles, one is the Lumpini Stadium, managed by the police, the other is the Radchadamnoen Stadium, managed by the army. Numerous media, newspapers and TV, that dealing with the daily Sport.

Currently, Thai Boxing is one of the most popular martial arts in the world, and practiced as a national sport in Thailand, where students begin the very young age.

However inspite of its complex cooking, the sticky rice is still cherished not only by the locals, but the visitors as nicely.

Sticky rice can be uncovered all about Myanmar. Restaurants serving native dishes have the kao hnyin in their menu. The rice is cooked in many varieties, largely for desserts.

Thai Visa Information

Well it is that time of year again, the high season is getting ready to start and many readers currently in their cubicles overseas are thinking of their time soon to be spent among the beautiful women and tropical beaches that Thailand is famous for.

Unfortunately, like Shangri-La, each year more obstacles seem to be placed in the path of those wishing to come back to the Kingdom. Most notable among these obstacles is the plethora of competing visa regulations being promulgated from the ordinance drafting machine that is Thai Immigration. To add confusion to complexity, many of the regional Consulates and Embassies are running things according to their own rules in a similar manner to the way a local chieftain runs his own fiefdom.

The rules get more complicated, but the game continues. Hopefully this will provide some insight for those looking to stay in the Kingdom for a long (or short) period of time.

Thailand Visa Exemption Stamps

First and foremost on the minds of short term travelers is the issue of Thailand visa exemptions. The visa exemption stamp is the 30 day stamp given to most tourists arriving at the Airport. Currently Thai Immigration is giving 30 day exemption stamps at the airport to anyone holding a passport from a country on the exemption list (US, UK, CA, most EU, AU, NZ, etc). Technically, these stamps are supposed to given an infinite number of times, provided the entrant is always coming through the airport. That being said, I have heard reports that this is not the case and more than about 3 entrances will get your passport heavily scrutinized (they can always turn you away as well).

At present, entrants seeking visa exemption stamps at land borders are being accorded a mere 15 days of lawful status. This is important to note because local immigration requires at least 21 days of status to process a visa extension or conversion. Therefore, the immigration officers have effectively barred long term status to those entering Thailand via a land border without a proper visa. If one wishes to remain in the Kingdom long term, then this is not an effective method.

Thailand Tourist Visas: Free If You Can Get One

After the less than spectacular tourist numbers last year, the Thai government announced a fee waiver for all Tourist visas sought abroad. This led to something of a backlash from Consulates overseas as the workload increased and the resources decreased. However, the plan seems to have had some positive effects as there has supposedly been an increase in tourist visa applications (possibly due to the fact that visa exemptions are now harder to come by).

Although initial tourist visa applications are being approved (if sometimes begrudgingly), subsequent applications are being viewed with a critical eye. The Royal Thai Consulate in Penang, the on-again off-again visa run destination for most farangs in Thailand has made the policy that they will not issue multiple tourist visas. This seems to be the prevailing attitude throughout the region, with some exceptions. As a consequence, those wishing to remain for a longer period than 3 months might be wise to seek out a non-immigrant visa rather than using exemptions or tourist visas.

The Rise of the Non-Immigrant Visa

It appears that non-immigrant visa applications are on the rise. Although tourist visas technically are classified as non-immigrant, for these purposes we are talking about B visas, O visas, and retirement visas. O visas are always popular with those staying in Thailand long term as they allow for 90 days per entry. Should one acquire a 1 year multiple entry visa, then it could be utilized 4 times for a duration of stay amounting to 90 days per entry. The Business visa is also popular for those who may be looking at making their vacation more full time by attempting to gain employment and applying for a work permit. Acquiring a Thai business visa can be a difficult task, particularly if one does not have company sponsorship, but it is a highly flexible visa from legal standpoint. Finally the retirement visa: perfect for those over 50 who can prove financial resources to cover their living expenses. The only major downside to this one is the fact that employment is prohibited, but in general it is much easier to obtain than some other categories. Those interested in possible employment should look at the Business visa.

In my opinion, the non-immigrant visa categories will become more popular as the border run is slowly phased out, but then again this time next year we could be talking about how no such visas get issued anymore. Long term status in Thailand can be hard to come by in Asia, so act accordingly if you are still back in your corner of the world because: prior planning prevents police detention.
