Some Thai Girls Aren’t Girls

Anyone who has ever visited Thailand will know about the beauty of Thai women. In their twenties, they are striking. In their thirties, they are looking more mature, but still most are very attractive.

The women working in the ubiquitous bars and massage parlors of Bangkok, Pattaya, and Phuket are mostly former housewives, believe it or not, married but separated, with two kids they left back in their village with their mothers. Most are from Isaan, the North-East corner of Thailand, which has a large amount of poverty. Some are from other parts of the country, especially Chiang Mai and Chiang Rai, and a very few are from Bangkok or central Thailand.

But about 1 in 100 is not a female at all, but a “ladyboy”, or katoey in Thai. Quite often, they appear more feminine than the real women. I have seen many a farang ogle and lust after a very sexy woman, not realizing that “she” is a “he”.

Like the women, most ladyboys are from Isaan. I have talked to a few on a one to one basis, and asked them when they first knew they wanted to be a female. All said they knew at an early age, around 5 or 6 years old. They said they liked the female manner, didn’t like rough sports, were partial to art and music.

Katoeys are an accepted part of Thai culture, considered to be a third sex in Thailand. Several are movie stars and TV announcers. One is a national kick-boxing champion. You will find ladyboys everywhere, working as waiters, store clerks, hairdressers, couriers, etc.

In North America and Europe, a sex-change (also called a gender re-assignment) operation is considered to be a big deal, requiring many months of psychological counseling before the operation to make sure the person is committed to the change.

In Thailand, a sex change operation is quite common. There are several clinics and hospitals which perform it, and the cost is a fraction of what the western charge would be, typically US00-7000. Nevertheless, for a poor person from Isaan, 00 is a huge amount of money.

There are three main areas in Bangkok where ladyboys are present in large numbers: Nana Entertainment Plaza (on Sukhumvit Soi 4), Patpong Road (off Silom), and Soi Cowboy (close to the intersection of Sukhumvit Road and Asoke Road, which has both BTS SkyTrain and MRT Subway stations).

At Nana, the majority of ladyboys are “pre-op”, meaning they still have a penis. At Patpong and Soi Cowboy, most are “post-op”, meaning they have had the operation to create a vagina. The operation involves cutting out a section of intestine, which will become the vagina. The penis is cut open and inserted into the intestinal tube; typically some of the scrotal sac is used to increase the length of the new vagina. The tip of the penis becomes the new clitoris, and is normally still sensitive after the procedure is finished and everything has healed. The ladyboys I talked to said they could still have an orgasm, but did not ejaculate.

Scar tissue is visible if the post-op ladyboy retains his/her public hair, but if it is shaved off, it is difficult to tell an artificially created vagina from the real thing.

However, this is typically not the end of the story in sex reassignment. The male body is typically larger than the female, even in Thailand, where many people seem to be 80% the size of western people. The ladyboy has to take hormones for a couple of years before the operation; these hormones help him grow breasts and reduce his facial and body hair growth. Thai men don’t usually have much body hair, compared to Western men, but they do have some; hormones or another treatment are needed to reduce or eliminate it. However, hormones have a side effect of reducing the ability to ejaculate.

Males typically have a protruding Adam’s apple, so that is yet another operation: it can be shaved by a surgeon to reduce or eliminate the protrusion. And many have electrolysis to eliminate body hair, especially in the armpits.

If you visit Nana Entertainment Plaza after 7PM (which is when it opens), you will find several hair-dressing establishments located on the decks that run around three sides of the structure. The ones at the front cater to the bar girls; the ones at the rear cater to ladyboys. You can watch some of the ladyboys preening and preparing their makeup.

Some of the bars are exclusively ladyboys. If you enter one such bar, you will find that most ladyboys are more than passable and some are strikingly beautiful. I don’t think I have ever seen an ugly ladyboy.

As far as relationships go, ladyboys are just like Thai women. They want a long-term relationship, and they will try hard to make the relationship work. Many speak some English, but you really need a product like Speak Easy Thai to help you learn some basic Thai vocabulary. If you can communicate better, you have a much better chance of a lasting relationship.

A part of Bangkok’s nightlife that should not be missed by any visitor, ladyboy cabaret shows are professionally done, with spectacular productions (lots of feathers and glitter, good music, and some comedy as well). You can see them at the Calypso Cabaret (Asia Hotel, Ratchathewi SkyTrain station), Golden Dome Cabaret (15 minute walk from Sutthisan subway station), and Mambo Cabaret in the former Washington Theater between Sukhumvit Soi 22 and 24.

Some Issues Thai Hotel Owners Have With Their Managers!

Our previous articles did focus on hotel owners and investor’s shortcomings, their habits and mistakes.

This article I like to focus on the shortcomings of some general managers. A general manager is a leading position that can lead to either failure or success.

The below are some of the comments we get from hotel owners and investors when they are talking to us about their hotel manager or general manager here in Thailand.

We trust that you see our articles as a benefit for hoteliers, owners and investors at all times. However, knowing the industry well, I foresee that this article might well trigger lots of comments.

However, we all have to be open-minded and accept that there are also managers, not only owners and investors, who are in-capable and who take advantage of others and abuse their authorities. We also have to accept that some managers have even shortcomings in ethics and personal values.

The below did actually happen!

The Manager and Suppliers

One manager I got to know of one general manager who never stopped recommending certain suppliers and it was found that he did receive commission on the sale of utensils, equipments and other goods from at least two of the supplier he recommended.  Commission and leader is like “water and oil” in term of ethical practices! Leadership style has a problem if this subject is rumored, raised, discussed.

Sales and Marketing

At least twice -as I know, the appointed opening general manager who has also been in charge for sales and marketing of two small scale resorts did cheat the owners with room revenues from travel agents.   As the resorts were in the pre-opening stage, the resort owners have not yet set up the proper company accounts. The un-ethical managers did give their own bank account numbers to agents for payments.  In one case, the damage was over 5 Million Thai Baht!!

Entertainment and Complimentary

All too often the manager entertains people who don’t bring any benefit for the business. Complimentary room nights for friends, lots of dinners and drinks for buddies are given!  Some managers did argue about that and say the privilege to entertain friends and others come with the position.  I do not agree! If this benefit is not written in a contract or on a approved benefit list, the manager should be a sample to other managers and show most ethical behavior.  In my opinion it is not acceptable to have 2000-3000 us$ entertainment bill for friends who don’t bring any benefit to the business.

The Manager only sits in the office.

Yes, this disturbs many owners. I do not disagree that some ‘office based’ managers in certain operations are very effective indeed.  However, for smaller boutique resorts and hotels, no system beat an ‘on the floor’ manager with ongoing staff and guest contact.

The Manager doesn’t understand the culture!

Several times I hear the owners telling me that their manager don’t understand Thai culture.

Some owners just want their manager to ‘blend in’ a little more, but the manager don’t want.

What owners most comment to me is that their manager never “Wai” (Thai greeting gesture); never smile (important in Thailand); never participate in certain staff activities, never respect certain things like a spirit house.

The Manager only complaints!

Yes, there are managers who focus more on the problems than on solutions.  Some inexperienced manager don’t understand that there are always changes in plan, changes in lay-out and changes in design during construction when working for the opening of a hotel.  Some changes are the result of poor planning, some changes are needed for unforeseen obstacles, and then, some changes are needed because of certain misunderstanding or mistakes which is human.

The Manager doesn’t prioritize during pre-opening.

Some manager just cannot focus on importance. The owner worries on how to finish the hotel as the construction company is not performing as promised.  One case I experienced, the manager only talked for over two weeks about his comfort and standard of his own living such as “my temporary apartment is not comfortable enough!”.  It is not wrong at all, but hearing about his apartment over weeks but never hearing about his work plan as a general manger may actually give a-not-so-good impression to the owners.   Hotel and resort openings are always rough and need 100% commitment and dedication.  Focusing only on one’s own comfort without focusing on work might give owners the wrong impression about the manager.

Consider the owner when prioritize the work.

Many times the manager and owner see the importance of outstanding “To Do’s” differently. As the manager is in the operation more often than the owner, the manager tries to prioritize what needs to be addressed and many times the ‘owner issues’ are not on this list. As every manager and owner in this world has his or her own habits and views, this becomes fast an issue with the owner.  May be, it is not general manager’s priority, but it is important for owner.  To avoid clash between GM and owner, consider owner’s priority as well.

The Manager is not professional

Yes, this also does happen!  There are managers who are not ethical and unprofessional and only want to have his or her personal gain.  I experienced one resort where the new manager during pre-opening did not lead the preparation and implementation of any hotel policies and procedures at all.  He only wanted to get the authority to make FF&E purchases.  Without any focus on preparing a policy for cash use, purchase policy, accounting standards etc, the manager only wanted cash to go buy things himself. Everyone wondered why he also needs a purchasing manager.

Manager should never forget, in a country like Thailand where kickbacks and commissions are everywhere, the manager soon will lose the respect and trust of the owners as the objective of every owner will be to avoid cash and to have transparent accounting and purchasing policies in place.

I sincerely hope that the above will help some managers to understand the Thai owners and investors better and the above tips should result in a longer lasting business relationship between owners and managers.

Public Entertainers’Guide to Taxation in Thailand

Pursuant to the local Thailand tax laws, the income of a public entertainer is subject to personal income tax in Thailand.

A foreign public entertainer who performs in Thailand is required to file a personal income tax return and pay Thailand personal income tax on the income earned for the performance, including any income that may be paid outside of Thailand for the performance and any benefits that the promoter in Thailand may provide to the public entertainer for the performance in Thailand, such as transportation and accommodation costs.

A foreign public entertainer is also required to obtain a tax clearance certificate from the Revenue Department prior to his or her departure from Thailand.

In the case where a public entertainer acts or performs in a group or as a team, the income received (even if received individually) shall be included in a “body of persons” personal income tax return, and the manager of the group or team has the duty and responsibility to file the income tax return and pay the personal income tax for the group or team as a “body”. Where however, a public entertainer in a group or a team is individually hired, each individually hired person is required to file a separate personal income tax return.

For the computation of the tax payable in Thailand, the public entertainer is allowed expenses as follows:
1. Expenses actually incurred necessarily; or
2. Unsubstantiated expenses calculated on the basis of 60% of income up to Bt 300,000, 40% of income over Bt 300,000, whereby the total deduction shall not exceed Bt 600,000.

The local Thai tax laws also impose strict withholding requirements on the promoter or the payer of income to the foreign public entertainer, whereby the payer is obliged to withhold tax according to the personal tax rates of 0-37%, depending on the level of income
Foreign public entertainers should note that none of the Agreements for the Avoidance of Double Taxation entered into between Thailand and foreign countries mitigate or reduce the imposition of personal income tax on payments made to them personally.

However, Thailand’s Double Tax Agreements with the developed OECD countries of Australia, Canada, France, Germany, Japan, UK and the US, contain an additional special provision, which prescribes that in the case where income in respect of a performance accrues not to the entertainer personally, but accrues to another person (e.g. an entertainer’s star company) then Thailand shall have taxing rights over that other person’s income.

For a star company that is established under a foreign law and carrying on business in Thailand, the local tax law requires the foreign star company to include the income in a corporate income tax return to be filed in Thailand, which income shall be subject to tax at the rate of 37% (i.e. 30% corporate income tax on profits plus 10% profits remittance tax).
However, for a star company that is established under a foreign law and not carrying on business in Thailand (which is usually the case), the local Thailand tax law does not require the foreign star company to file a tax return in Thailand, but requires the payer in Thailand to withhold 15% tax and provide the foreign company with a non-resident withholding tax certificate.

It is important, therefore, for public entertainers with star companies, which legally own or otherwise hold the legal rights to public performances, to ensure that the promoter in Thailand fully understands your legal structure and correctly applies taxes according to the prescriptions in the Double Tax Agreements.
